Terms of Service
These Terms of Service ("Terms") govern your use of the Selluminate application and website ("Service") operated by Selluminate ("we", "us", or "our"). By using our Service, you agree to these Terms.
1. Description of Service
Selluminate is an AI-powered product listing generator that allows Shopify merchants to upload product photos and automatically generate complete, SEO-optimized product listings for publishing to their Shopify store and other ecommerce platforms.
2. Eligibility
You must be at least 18 years old and have a valid Shopify store to use this Service. By using Selluminate, you represent that you meet these requirements.
3. Account and Access
Access to Selluminate is granted through your Shopify account via OAuth authentication. You are responsible for maintaining the security of your Shopify store credentials. You may not share your access with others or use the Service for multiple stores under a single plan unless your plan explicitly permits it.
4. Acceptable Use
You agree not to use Selluminate to:
- Generate listings for counterfeit, illegal, or prohibited products.
- Upload images you do not own or have rights to use.
- Attempt to reverse engineer, scrape, or abuse the Service.
- Circumvent usage limits or billing systems.
- Use the Service in any way that violates Shopify's Terms of Service.
5. Subscription Plans and Billing
Selluminate offers a free tier with limited generations and paid subscription plans with higher limits. Paid plans are billed monthly through Shopify's billing system. You authorize Shopify to charge your account for the applicable subscription fee. Plans auto-renew unless cancelled. Generation counts reset on your monthly billing date.
6. Free Tier
Free tier users receive a limited number of lifetime generations at no charge. Free tier users may not export CSV files or access all platform features. We reserve the right to modify free tier limits at any time.
7. Cancellation and Refunds
You may cancel your subscription at any time through your Shopify admin. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months. If you believe you were charged in error, contact us within 7 days.
8. AI-Generated Content
Selluminate uses artificial intelligence to generate product listing content. You acknowledge that:
- AI-generated content may contain errors or inaccuracies.
- You are responsible for reviewing all generated content before publishing.
- You own the generated content and are responsible for its accuracy.
- We do not guarantee that generated content will meet any specific requirements of Shopify, Amazon, Etsy, or any other platform.
9. Intellectual Property
The Selluminate application, its design, and underlying technology are owned by Selluminate. You retain ownership of your product images and the listings generated from them. You grant us a limited license to process your images solely to provide the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Selluminate shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your purposes.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
